The IKA technical committee will publish an interpretation and clarification on the compliance with the class rules of kites produced before 2012 as soon as possible with regards to such kites being able to be used at the 2013 kiteracing world championships.
IKA Class Rules B.1.2 states that ""Production boards built before 2011 and production kites build before 2012 will be included on the relevant Production Equipment List."
After equipment inspection on the evening of the first day of the 2013 Kiteracing European Championships in Gizzeria, Italy, the Race Committee filed a protest against three sailors using 2013 Temavento Racing Boards. The protest was heard on day 2 by an ISAF International Jury.
Based on the report of the event measurer, the protest was filed because the equipment was found not to be in compliance with the data provided by the manufacturer, and furthermore because the railshape of the front part of the inspected boards showed variation outside of reasonable production and measurement tolerances. The building specifications of the brands itself are subject to a confidentially agreement in the builders contract. Only the class measurers have access to such data and use such data for measurement at events.
The international jury thereafter requested the race committee to measure all Temavento Racing boards present at the championship. A total of 19 boards were found to be not in compliance with the class rules.
The IKA class rules require all equipment used in course racing events to be "series production". According to the builders contract, any builder "agrees to ensure a consistent product strictly in accordance with the Manufacturing Specification and with the highest possible degree of uniformity in every respect".
The International Jury's decision was to disqualify all sailors using boards found not to be in compliance with the class rules from the races of day 1 and 2. The equipment involved is not allowed to be used in competition anymore.
In the meatime, Temavento has published statements on their facebook page as follows:
Temavento Race Engineering: "I wanted to point that no one of our riders and customer were aware about the wrong measurement of bow of the board. No one of them can be involved in a wrong production after # 31. Our factory and myself are the only one to blame. I am deeply sorry for them all."
Temavento Race Engineering: "Starting from Monday july 29 in the shortest possible production time, TemaVento will replace all boards with serial number higher then #31 being found defective in measurements of the bow. All replaced boards will be inspected by an official FIV measurer prior to ship them. Temavento will contact the customers involved in the warranty procedure within August 4. However, if during further investigation, the Class, Race Committee and/or jury finds proof that a sailor has knowingly used a class illegal board, further action may be taken, including the possibility of a hearing under rule 69 which may result in suspension of the sailor from future competition.
Also, further action may be taken against the manufacturer after full investigation of the incident. Investigation will commence in the course of this week.
